This is a petition for grant of regular bail for offence under Section 376/34 of the Indian Penal Code. According to first information report, the petitioners and others are said to have committed rape on the victim.

The learned counsel for the petitioners submits that the victim-girl in her statement under Section 164 of the Criminal Procedure Code, vide Annexure 5, alleged commission of rape by four persons, including one Parveen Kumar Singh. However, she has filed affidavit, vide Annexure 3 series, that she has already married with Parveen Kumar Singh and is living with him as husband

Patna High Court Cr.Misc. No.13237 of 2017 (3) dt.02-05-2017 2/2 and wife. Contention is that the matter is of love affairs just to pressurize, the false case has been lodged and after marriage with Praveen Kumar Singh everything subside. Co-accused, Randhir Kumar Singh, has already been allowed bail by a coordinate Bench of this Court in Cr. Misc. No. 33691 of 2016, vide Annexure 4.

Considering the entire facts, aforesaid, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Ghoghardiha P.S. Case No. 121 of 2015 to the satisfaction of the Additional Sessions Judge, I, Madhubani, or successor Court.
