JUSTICE RAJIV ROY ORAL ORDER 18-09-2023 Learned counsel for the petitioners prays for and is allowed to implead the Engineer-in-Chief cum Special Secretary, Public Health Engineering Department, Bihar, Patna as respondent no.5 in course of the day.
Heard Mr. Lalan Kumar Singh, learned counsel for the petitioners as also the State.
The petitioners have prayed for the following relief: (i) that an appropriate writ or direction be issued
Patna High Court CWJC No.2193 of 2018(4) dt.18-09-2023 2/3 to respondents commanding them to consider and absorb in regular establishment from the date when juniors have been absorbed in the regular establishment in the light of the judgment passed in the case of Siyaram Singh and others;
(ii) that an appropriate writ or direction be also issued to the respondents to consider and grant all the benefits which have been granted to the similarly situated persons;
(iii) any other relief or reliefs may be granted to the petitioners as they are found legally entitled to in the facts and circumstances of the case. Mr. Singh fairly submits that both the petitioners shall be approaching the concerned respondent with all the supporting documents so that the same can be considered and taken to its logical conclusion. He submits that he will be also annexing the copy of the order passed by a coordinate bench of this Court in C.W.J.C. No. 11533 of 2018 disposed of on 12.5.2023 in support of their case.
The petitioners are well advised to approach the newly added respondent no.5, the Engineer-in-Chief cum Special Secretary, Public Health Engineering Department,
Patna High Court CWJC No.2193 of 2018(4) dt.18-09-2023 3/3 Bihar, Patna within a period of eight weeks from today. If any such representation is filed by the petitioners, the same shall be considered and reasoned order will be passed within six months from the date of receipt of the representation. The writ petition stands disposed of with the aforesaid observation.
