JUSTICE SUDHIR SINGH ORAL ORDER 22-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 392 of the Indian Penal Code.

Prosecution case, as per informant, is that after collecting money while he was going on a bus and it reached near Jhalari Chowk, suddenly motorcycle borne some miscreants boarded on it and on the point of pistol looted his money and the bag containing other articles including cash.

It has been submitted on behalf of the petitioner that he is in custody since 5.5.2016. Chargesheet has been submitted against the petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioner. Petitioner is not named in the F.I.R. His name has come in the confessional statement of the co-accused. He has not been put on T.I.P. There is no recovery of any incriminating article from the possession of the petitioner. On behalf of the State, it is submitted that petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the

No.33294 of 2016 (3) dt.22-09-2016 2/2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of Sri Ashok Kumar-II, Judicial Magistrate, Ist Class, Udakishunganj at Madhepura, in connection with Gwalpara P.S. Case no. 21 of 2016 corresponding to G.R. Case no. 233 of 2016.
