JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 341, 323, 325, 302, 504, 506/34 of the Indian Penal Code and Section 27 of the Arms Act.

No doubt, petitioner is named in the first information report but he is said to be a member of unlawful assembly and it was co-accused Anoj Yadav, who opened fire on the deceased. Moreover, having more or less similar allegation, co-accused Bhishan Yadav has already been granted privilege of bail by this Court vide order dated15.9.2015 passed in Cr. Misc. No.42217 of 2015.

Accordingly, the petitioner above named is directed

Patna High Court Cr.Misc. No.33878 of 2016 (2) dt.18-08-2016 2/2 to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri A.K. Tripathi, Additional Sessions Judge 1st, Saharsa in connection with Basnahi P.S. Case No.08 of 2014, subject to the condition that any attempt by petitioner or on his behalf to tamper with the prosecution evidence shall give liberty to the trial court to cancel the bail bond of the petitioner after due and proper enquiry.
