JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 3 12-04-2017 Heard learned counsel for the petitioners, learned counsel for the State and learned counsel for the informant. The present application has been filed by the petitioners for grant of bail in Chand P.S. Case No.119 of 2015 registered under Sections 147, 148, 149, 323, 324, 326, 307, 504, 506 of the Indian Penal Code in which subsequently Section 302 of the Indian Penal Code and 27 of the Arms Act have also been added.
The prayer for bail of the petitioners was earlier rejected by this Court vide order dated 19.05.2016 passed in Cr.
Patna High Court Cr.Misc. No.11176 of 2017 (3) dt.12-04-2017 2 / 2 Misc. No. 21541 of 2016.
By aforesaid order dated 19.05.2016 liberty was granted to the petitioners to renew the prayer for bail of trial is not concluded within nine months from the date of framing of charges, till date, the charges have not been framed. It would be evident from the report dated 17.03.2017 submitted by the learned A.C.J.M., Bhabhua, Kaimur that the case of the petitioners has been committed to the court of sessions on 16th March, 2017.
In that view of the matter, renewal of the prayer for grant of bail in the present application is premature. Accordingly, the application is dismissed.
