The petitioner seeks bail in Nautan P.S. case No. 01 of 2017 under Section 379/411 of the Indian Penal Code. The informant alleged that his motor cycle bearing registration No. UP53U-1690 was stolen away few days ago but he saw the petitioner on his stolen motor cycle on 02.01.2017 and caught him.
The learned counsel for the petitioner submits that petitioner never committed theft of any motor cycle. The petitioner has falsely been implicated in the case. The informant did not lodge the case for theft of his motor cycle. The petitioner has got no criminal antecedent and he is in jail since 03.01.2017. No.11154 of 2017 (3) dt.07-04-2017 2/2 cycle the informant did not lodge the case, petitioner has got no criminal antecedent and he is in jail for last three months, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-XII, Siwan in Nautan P.S. Case No. 01 of 2017.
