JUSTICE BIRENDRA KUMAR ORAL ORDER 10-12-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147,341,323,353,504,225(B) of the Indian Penal Code. In the past, prayer for anticipatory bail to the petitioner was refused by order at Annexure-1. Submission is that police has not sent up the petitioner for trial in connection with the said Salimpur P.S.Case No.87 of 2018. The aforesaid ground does not make out a case that the petitioner has apprehension of being arrested in the case.

If the learned court below disagree with the

Patna High Court CR. MISC. No.79691 of 2019(3) dt.10-12-2019 2/2 police and takes cognizance against the petitioner, the petitioner may appear before the learned court below and court below shall consider that the police had not found allegation against the petitioner true. The FIR is also against unknown. With the aforesaid observation, this application stands disposed of.
