2. This is the second attempt for bail of the petitioner as earlier such prayer was rejected by order dated 22.05.2023 in Cr. Misc. No. 21837 of 2023.

3. The petitioner seeks bail in connection with Buxar (Industrial) P.S. Case No. 196 of 2022 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 307, 302, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.

4. The following order was passed on 22.05.2023 in Cr. Misc. No. 21837 of 2023 which reads as under: "Heard learned counsel for the

This application for grant of regular bail arise out of Buxar (Industrial) P.S. Case No. 196 of 2022 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 307, 302, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.

It has been alleged that the petitioner along with accused persons came with Gun, pistol and katta in front of informant's brother and thereafter, Surendra Singh ordered all accused persons to fire upon the informant's brother as a result he was died.

The petitioner is one of assailant of the deceased and in the indiscriminate firing, three persons were injured out of whom one person, namely, Dharmendra Singh (ExMukhiya) died. In view of the aforesaid fact, this Court is not inclined to grant bail to the petitioner.

Accordingly, the prayer of bail of the petitioner is rejected herewith.

The Trial Court is directed to expedite the trial."

5. In course of argument, it has come that in the trial out of nine witnesses, six witnesses have been examined one witness has been tendered and only two official witnesses are to be examined. The petitioner is in jail since 02.12.2022.

6. Since the trial is on the verge of completion, this application is dismissed.

7. The Superintendent of Police, Buxar is directed to produce the official witnesses in the trial so that the trial is not delayed as the petitioner is in custody since more than two
