21-09-2016 Heard Sri Bishwajeet Singh, learned counsel assisted by Sri Kundar Kumar Singh, learned counsel for the petitioner and Smt. Nirmala Kumari, learned Addl. Public Prosecutor. This is the 4th attempt for grant of bail in Sessions Trial No. 2387 of 2014/2388 of 2014 (arising out of Saharsa Sadar P.S. Case No. 197 of 2013) registered for offence under Sections 363, 366-A, 376-G/34 of the Indian Penal Code and Sections 3, 4 & 5 of the Immoral Traffic (Prevention) Act, 1956. In this case, by order dated 24-08-2016, a report was called for from the court below, which has been received and kept at flag 'A'. The report dated 09-09-2016 of learned 1st Additional Sessions Judge, Saharsa suggests that out of 23 prosecution witnesses, 08 witnesses have already been examined. Meaning

Patna High Court Cr.Misc. No.35814 of 2016 (3) dt.21-09-2016 2/2 thereby that trial is going on expeditiously. Accordingly, there is no reason to review my earlier order.

The prayer for bail again stands rejected.

However, while dismissing the present petition, it is desirable to observe that learned court below may take all steps for early disposal of the case. While proceeding with the case, the learned Trial Judge is required to take up the matter at least once in a week.

Let a copy of this order be sent to the court below forthwith.
