The petitioner apprehends his arrest in Balrampur (Telta O.P.) P.S. case No. 81/2019 registered under Section 30(a) of the Bihar Prohibition & Excise Act.

The informant, S.I. of Telta O.P. P.S., intercepted a vehicle bearing registration No. BR07PB-7262 and recovered 186 liters of Indian made foreign liquor of different brands. The apprehended accused disclosed that they had taken the vehicle from the petitioner as the petitioner happens to be their friend. It is submitted that petitioner has no knowledge that the apprehended accused would carry liquor in his personal and private vehicle. The petitioner has got no criminal antecedent. No.60056 of 2019(2) dt.14-10-2019 2/2 friend to go to see his ailing relative but the apprehended accused without knowledge of the petitioner started transporting liquor, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Katihar in connection with Balrampur (Telta O.P.) P.S. case No. 81/2019, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
