2. The petitioner has prayed for regular bail in a case instituted for the offence under Section 21(C) of N.D.P.S. Act and Section 30(a) of Bihar Prohibition and Excise Act, 2016. 3 As per FIR. it is a case of recovery of 9.5 litres Codeined cough syrup from the possession of the petitioner.

4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. The alleged recovered cough syrup does not belong to the petitioner. The petitioner is in custody since 18.07.2023.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned District & Sessions Judge, Madhepura, in connection with Gwalpara P.S. Case No. 130 of 2023.
