JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-01-2020 Petitioner seeks bail in connection with Kasim Bazar P.S. Case No. 112 of 2019 registered for the offences punishable under Sections 399/401 of the Indian Penal Code and Sections 25(1-B)(a), 26 and 35 of the Arms Act.

Allegation is of recovery of one country-made pistil with two cartridges from the petitioner and it appears that he is accused in some other cases.

Submission of learned counsel for the petitioner is that due to enmity with the local Daroga he has falsely been implicated and he is in custody for more than seven months. Heard learned APP also.

In view of above facts and circumstances, let petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of

Patna High Court CR. MISC. No.58170 of 2019(3) dt.08-01-2020 2/2 the like amount each to the satisfaction of the Chief Judicial Magistrate, Munger, in connection with Kasim Bazar P.S. Case No. 112 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition that he has to appear before the Police Station of his area for a period of six months, so that the police may watch his conduct.

Let a copy of this order be sent to the Superintendent of Police, Munger for needful.
