Heard learned counsel for the petitioner and the learned A.P.P. for the State as also the learned counsel for the informant. The petitioner apprehends his arrest in connection with Simri P.S. Case No.188 of 2019 registered under Sections 448, 376 and 506 of the Indian Penal Code.
The accusation is that the informant after receiving the information of his sister-in-law, namely, Renu Devi, through mobile about committing rape on her by this petitioner, the informant went at the village of his sister-in-law and saw that she has lost her vision and while weeping, she asked the informant that this petitioner pointed screw driver at her and gave threatening to kill her through pistol if she would raise alarm. Learned counsel for the petitioner submits that, in fact, Ghurul Ram, the uncle of the petitioner, had lodged Simri P.S. Case No.169 of 2018 under Sections 341, 323, 504 and 436/34 of the Indian Penal Code and under the S.C./S.T. Act against the husband of the sister-in-law of the informant and others, due to that reason, only to put undue pressure, the present case has been lodged. The petitioner has no criminal antecedent.
Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-IV, Buxar, in connection with Simari P.S. Case No.188 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
