JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-09-2019 This application, for grant of anticipatory bail, arises out of Aurangabad Muffasil P.S. Case No. 147/2019, disclosing offences under Sections 147, 148, 341, 323, 308, 379, 354 of the Indian Penal Code.

Prosecution case is that while the orchestra programme was going on, the petitioner and other accused persons assaulted the informant and others.

Submission of learned counsel for the petitioner is that the F.I.R. itself shows that there was scuffle between the partied during Orchestra programme and no specific allegation has been attributed to the petitioner and though there is allegation of assault, injury sustained by the informant was found simple in nature.

Having heard both sides, considering the facts and circumstances, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Aurangabad Muffasil P.S. Case No. 147/2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
