The petitioner seeks bail in anticipation of his arrest in connection with Bairiya P.S. Case No. 384 of 2019 dated 05.11.2019 instituted for the offences under Sections 147, 148, 149, 341, 323, 342, 307, 332, 333, 353, 427, 436, 504, 506 and 120B of the Indian Penal Code and Sections 3/4 of the Damage to Public Property Act.

It has been alleged in the FIR that the crowd which had collected at a place for protesting against the murder of one Munna Sah had become restive. The police party also was attacked. The hands of one Santosh Singh was suspected by the crowd of having committed the murder.

Patna High Court CR. MISC. No.334 of 2022(2) dt.22-01-2022 2/2 So far as the petitioner is concerned, he is a Press Reporter working for a particular news channel who had visited the place only for covering the aforesaid incident. However, maliciously, he too has been made accused in this case.

The learned counsel for the petitioner has submitted that the FIR was presented before the learned Magistrate after nine days of its report without any reason. Some of the other accused persons of this case have been granted anticipatory bail by this Court as well as by other co-ordinate Benches of this Court.

Regard being had to the aforestated facts, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bairiya P.S. Case No. 384 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C.
