2. Learned counsel for the petitioner has submitted that though the anticipatory bail of the petitioner who is motherin-law of the deceased was earlier rejected by this Court, but he is renewing the prayer on the fresh ground that the husband of the deceased has been acquitted in Session Trial No. 68 of 2022 vide judgment and order dated 31.05.2023. The informant, who was examined as PW 2 in the trial, in his deposition, has stated that his daughter was living happily with her husband Shatrughan Tiwari and there was no maltreatment at the hands of the accused persons.
3. On the other hand, learned APP has opposed the
Patna High Court CR. MISC. No.64234 of 2023(2) dt.03-11-2023 2/2 prayer for bail.
4. Considering the fact that the husband has been acquitted as the prosecution failed to prove the case, let the petitioner, be released, in the event of her arrest or surrender within four weeks before the learned court below, on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate Ist Class, Lakhisarai in connection with Halsi P.S. Case No. 159 of 2021, subject to the following condition:- The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
