JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-08-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. The victim has already returned to his home and his statement was recorded under section 164 of the Cr.P.C. Submission on behalf of the petitioners is that the victim had some relation with one Shanti, who happens to be sister of petitioners, and as a matter of fact, the victim was caught by the petitioners in their house and, after that, they informed the family members of the victim, who came there and took the victim but, later on, the informant lodged the present case with an ulterior motive. It is further submitted that the learned Additional Sessions Judge has mentioned in the impugned order that only a case under
Patna High Court Cr.Misc. No.34462 of 2016 (2) dt.20-08-2016 2/2 section 387 of the Indian Penal Code is made out against the petitioners.
Considering the aforesaid facts and circumstances as well as submission of the parties, and also taking note of this fact that petitioners do not have any criminal antecedent, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st class, Kaimur at Bhabua, in connection with Kudra P.S.
