1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Phulwari Sharif Police Station Case No. 1068 of 2025, dated 03.07.2025, disclosing offences under Sections 126(2)/115(2)/132/352/351(2)/351(3)/3(5) of the Bhartiya Nyaya Sanhita and Section 30(a) of the Bihar Prohibition and Excise Act.
3. The prosecution story, as per the First Information Report, is that on 03.07.2025, during patrolling, the police intercepted a Ertiga vehicle, bearing registration no. BR01JD-6699, in which four persons were sitting. On seeing the police, two female persons managed to escape, while two persons were apprehended. From their
Patna High Court CR. MISC. No.62218 of 2025(2) dt.24-09-2025 2/3 possession, 250 ml of liquor was recovered in a Bisleri bottle from the vehicle, in question, and on breath analysis the arrested co-accused person were found under the influence of alcohol.

Learned counsel for the petitioner submits that the petitioner is a lady and she has falsely been implicated in the present case merely because she happens to be the registered owner of the said vehicle. He next submits that the petitioner runs her livelihood by renting the car on hire basis and and that she was not aware about the fact that illicit liquor was carried by the arrested co-accused persons in the said vehicle. The petitioner has got no criminal antecedent.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that the petitioner is a lady and she happens to be the registered owner of the vehicle and the vehicle, in question, from where illicit liquor has been recovered, was being plyed on rental basis, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his arrest
Patna High Court CR. MISC. No.62218 of 2025(2) dt.24-09-2025 3/3 or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Excise Judge-1, Patna, in connection with Phulwari Sharif Police Station Case No. 1068 of 2025, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
