The sole petitioner, who is in custody in Mahila P.S. Case No.3/2015 registered for the offence under Sections 376, 506 of the Indian Penal Code and Section 4 of the POCSO Act, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that as per F.I.R. itself, the petitioner is cousin brother of the informant and due to land dispute, the petitioner has been made accused in the present case.
However, after going through the F.I.R. as well as the statement of the victim girl recorded under Section 164 of the
Patna High Court Cr.Misc. No.34672 of 2016 (2) dt.22-08-2016 2/2 Code of Criminal Procedure, which has been brought on record as Annexure-3 to the petition, I do not find any ground to extend the privilege of bail.
The petition stands dismissed.
