The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 307, 504 and 379 of the Indian Penal Code. It is alleged that with regard to the dispute for construction of the house the agnate of the informant started abusing and assaulting him. It is alleged against the petitioner that he assaulted with Farsa on the head of the informant. It is submitted by learned counsel for the petitioner that for the occurrence of 19.06.2014 the FIR was registered on 24.06.2014 when injury suggests simple in nature
Patna High Court Cr.Misc. No.41802 of 2015 (2) dt.09-10-2015 2/2 caused by hard and blunt substance. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Moreover, in the background of property dispute the accusation has been levelled.
Considering the fact that the accusation is not being corroborated with the medical opinion, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Motihari, East Champaran in connection with Kotwa P.S. Case No. 119 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
