JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 10-03-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 302/120B of the Indian Penal Code and u/s 27 of Arms Act.
As per the prosecution case, this petitioner along with other accused persons committed the murder of husband of informant because she earlier filed a case u/s 307 of the IPC against the accused persons and they were pressurizing to compromise the case but when she did not compromise the case they killed her husband.
Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR. The name of petitioner has surfaced in this case during the course of investigation in the
Patna High Court CR. MISC. No.72 of 2022(2) dt.10-03-2022 2/2 confessional statement of co-accused, Rahul Singh and only material that has come against this petitioner that on the date of occurrence he was in touch with co-accused, Rahul Singh, through whats app. Petitioner is in custody since 22.11.2021 and investigation in this case is complete.
Learned counsel appearing for the State opposes the prayer for bail.
Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-V, Siwan in connection with Maharajganj PS case No.200/2021.
