Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Sangrampur P.S. Case No. 206 of 2021 lodged under Sections 392, 414 of the I.P.C.

As per the prosecution case, the informant has disclosed that he was coming to his house from his shop then in the way three unknown persons have surrounded him and all the three persons started snatching his laptop, hard-disc, two mobiles of his customer and one person has snatched his mobile and two persons fled away with the mobile of the informant and

Patna High Court CR. MISC. No.154 of 2022(3) dt.08-12-2022 2/3 third person caught who disclosed his name as Yunus Alam (present petitioner) and a motorcycle was also recovered, with this allegation the F.I.R. has been lodged.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Learned counsel submits that nothing incriminating material was recovered from the possession of the petitioner. Learned counsel further submits that the said motorcycle is not looted motorcycle rather it is a motorcycle of co-accused and petitioner was not put on T.I.P. Learned counsel submits that antecedent of the petitioner is clean and he is in custody since 26.09.2021 and charge-sheet has already been filed in this case. From the report received, it also transpires that petitioner has no criminal antecedent.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of Smt. Manjushree Kumari, learned J.M. 1st class, Motihari, East Champaran in connection with Sangrampur

Patna High Court CR. MISC. No.154 of 2022(3) dt.08-12-2022 3/3 P.S. Case No. 206 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
