A counter affidavit of Respondent no.6 is on record and paras-4 and 5 read as follows:

"4. That the petitioner was neither working on contract on the post of Agriculture Coordinator nor is a government employee. As per the admitted case of the petitioner, he worked on the post of "Subject Matter Specialist"

Patna High Court CWJC No.2234 of 2018(4) dt.18-09-2023 2/2 in the District Agriculture Office, Vaishali and therefore he is not entitled for relaxation in the upper age limit.

5. That in view of the aforementioned facts and circumstances, the instant writ application has no merit and since the petitioner was over age on the reference dated i.e. 1.8.2014, the petitioner was disqualified for being considered for the appointment to the aforementioned post".

Learned counsel for the State submits that the petitioner do not have any case in the matter. Be that as it may, since no one has appeared on behalf of the petitioner, the writ petition is dismissed for nonprosecution. (Rajiv Roy, J) Ravi/- U
