The petitioner apprehends his arrest in a case under Sections 409, 419, 420 and 471 of the Indian Penal Code. The petitioner was a Panchayat Rojgar Sevak, Panchayat Mangobandar, Block Khaira. One Shankar Prasad Yadav made allegations of irregularities in implementation of the schemes under MGNREGA. On such, enquiry was held and some of the allegations were found true. One Muso Sharma was dead but payment of wages was made in his name. Similarly, in the name of para-teachers, fraudulent withdrawal was made in the name of Ramnandan Kumar. It is submitted that the petitioner has already made payment of the amount alleged to have been defalcated and the petitioner has already been removed from service.

No.40709 of 2015 (2) dt.05-10-2015 2/2 Considering the nature of allegation that the petitioner made interpolations in making payment in the name of fake persons, I am not inclined to enlarge the petitioner on anticipatory bail in Khaira P.S. Case No. 142 of 2015. Accordingly, the same is rejected.
The petitioner, if so advised, may surrender in the court below and make prayer for regular bail. The learned court below shall consider the prayer for regular bail of the petitioner and dispose of the same preferably on the same day. (Prabhat Kumar Jha, J) Dilip/- U T
