====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 10-09-2025 Heard the learned Counsel for the petitioner and the learned Additional Public Prosecutor for the State.
2. The petitioner is apprehending his arrest in connection with Araria P.S. Case No. 68 of 2025, registered for the offences punishable under Sections 126(2), 115(2), 109, 118(1), 74, 352, 351(2) and 3(5) of Bharatiya Nyaya Sanhita.
3. The prosecution case, as per the First Information Report is that, on 23.02.2025 while the petitioner was harvesting mustard crops on his land, the petitioner along with other co-accused persons about ten in numbers arrived there, assaulted the labourers by fist, spade etc. It has further been alleged that the petitioner assaulted
Patna High Court CR. MISC. No.61019 of 2025(2) dt.10-09-2025 2/3 the informant's labourer, namely, Mukesh Rishidev with spade on his head, causing head injury.
4. Learned counsel for the petitioner submits that there is land dispute between the parties. The petitioner and the informant both are claiming the subject land on which the mustard crops were standing. The injury sustained by the victim is simple in nature as would be evident from the injury report which is annexed at Annexure-P/4.

Having regard to the submissions made by the parties taking into consideration the nature of dispute and the fact that both the parties are neighbours, having land dispute and the injuries sustained by the victim is simple in nature, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Araria P.S. Case No.
