JUSTICE SUDHIR SINGH ORAL ORDER 3 29-10-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners seek bail in a case registered for the offences punishable under Sections 147/148/149/452/504/506/364/427/380/ 307/302/324 and 326 of the Indian Penal Code. As per the allegation, it is a case of murder of the informant's son by forming unlawful assembly. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. Petitioners are in custody since 23.03.2015. Chargesheet has been submitted in the present case. There is no allegation of tempering with the evidence against these petitioners. Altogether 26 persons and 40 unknown persons have been made accused in the present case. Petitioners
Patna High Court Cr.Misc. No.41124 of 2015 (3) dt.29-10-2015 P2/2 are also among them and they have been named in the FIR along with others. There is no specific injury attributed against these petitioners nor there is any injury caused upon the deceased. The other co-accused named in the FIR have been granted bail vide Cr. Misc. No. 43038 of 2015.
It has been submitted on behalf of the State that petitioners are named in the First Information Report. Considering the aforesaid facts and circumstances, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Sadar P.S. Case No. 132/2015.
