The petitioner seeks regular bail in connection with Sessions Trial No.140 of 2018 arising out of Panapur P.S. Case No.49 of 2015 registered for the offences punishable under Sections 147, 148 of the Indian Penal Code and 3⁄4 of Explosive Substance Act and 17 C.L.A. Act.
It has been submitted that the petitioner is not named in the F.I.R. rather in course of investigation the name of this petitioner has surfaced on the basis of confessional statement of co-accused Ganesh Sharma and Manoj Kumar Singh. The said two accused persons, who disclosed the name of this petitioner, have been allowed bail by different Benches of
Patna High Court Cr.Misc. No.28936 of 2018 (3) dt.28-06-2018 this Court in Cr.Misc.No.15350 of 2016 and Cr.Misc.No.1125 of 2016. It has been submitted that nothing has been recovered from possession of the petitioner nor T.I. Parade has been conducted as yet. The petitioner is in custody since 03.01.2018. The learned A.P.P. for the State opposed the submission.
Considering the facts and circumstances of the case, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Sessions Judge X, Saran at Chapra in connection with Sessions Trial No.140 of 2018 arising out of Panapur P.S. Case No.49 of 2015. (Sanjay Kumar, J) Harish/- U
