The petitioners apprehend their arrest in connection with Matiariya P.S. Case No. 11 of 2019, registered under Sections 498(A) and 307/34 of the Indian Penal Code and Sections 3⁄4 of the Dory Prohibition Act.

The accusation is of torturing of informant by her husband and in-laws due to non-fulfillment of demand of dowry and removing from her matrimonial house along with her child. Learned counsel for the petitioners submits that petitioners are mother-in-law and father-in-law of the informant

Patna High Court CR. MISC. No.59953 of 2019(2) dt.23-09-2019 2/2 and they have falsely been implicated in the present case due to ulterior motive. In fact, due to settlement of dispute in between informant with her husband Nausad Ansari, her husband has already been allowed bail on 25.05.2019 passed in B.P. No. 1131 of 2019 by the court of 9th Additional Sessions Judge, West Champaran, Bettiah.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Bettiah, West Champaran, in connection with Matiariya P.S. Case No. 11 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
