Learned counsel for the petitioners seeks permission to withdraw this application as against the petitioner no.5 as he has already been arrested by the police, during pendency of this application.
Permission is granted.
Accordingly, the instant application as against the petitioner no.5 is dismissed as withdrawn.
Patna High Court CR. MISC. No.61930 of 2022(2) dt.10-01-2023 2/3 Now, this application is being heard for consideration of anticipatory bail as against the petitioner nos.1, 2, 3 and 4 only.
Heard learned counsel for the rest of the petitioners and learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 147, 149, 342, 323, 307, 504 and 506 of the Indian Penal Code. Allegation against the petitioners is that they along with 15-20 unknown male and female persons assaulted the informant and tied him with rope and put him in sunlight. Learned counsel for the petitioners submits that the petitioners are innocent and have been falsely implicated in this case. He submits that there is general and omnibus allegation levelled against the petitioners. He submits that there is no specific overt act against the petitioners. He further submits that petitioners have got one criminal antecedent as stated in para-3 of this application.
Learned APP for the State opposes the prayer for bail. Considering the facts and circumstances of the case, let the above named petitioners in the event of their arrest or surrender before the learned Court below within a period of six
