JUSTICE SANJAY PRIYA ORAL ORDER 08-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Bihara P.S. Case No. 176 of 2016 instituted for the offence under Sections-302, 120(B)/34 of the Indian Penal Code and 27 of the Arms Act. It has been submitted that the petitioner is not named in the written report by the informant. The informant has taken name of this petitioner subsequently in his further statement before the police.

The C.D. has been received.

The learned APP referring to para-8 of the C.D. pointed out that the informant has claimed to identify this petitioner along with other co-accused Ajay Yadav, Anil Yadav. In the further statement, the informant has alleged that this

Patna High Court Cr.Misc. No.13092 of 2017 (3) dt.08-05-2017 2/2 petitioner was holding the deceased and co-accused Ajay Yadav along with Anil Yadav fired. The petitioner is said to be in custody since 23-11-2016.

In such circumstances, the prayer for bail is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Bihara P.S. Case No. 176 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Saharsa subject to condition that both the bailors should be close relatives of the petitioner.
