The petitioner has prayed for bail in a case registered for the offence punishable under sections 120(B)/182 of the Indian Penal Code and Section 8/20(b)(ii)(B)/58(2) of the NDPS Act.
Prosecution case relates to recovery of 1.5 kg. Ganja from one Ertiga Car bearing Reg. No. BR02BG5704 and five accused persons were arrested on spot.
Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this Case. He was not arrested on spot. The recovered article comes below the
Patna High Court CR. MISC. No.67228 of 2023(2) dt.01-11-2023 2/2 commercial quantity. Similarly situated other accused person has already been enlarged on bail by another coordinate Bench of this Court vide order dated 16.10.2023 passed in Cr. Misc. No. 66288 of 2023. Petitioner is languishing in judicial custody since 31.05.2023.
Learned APP appearing for the State has opposed the prayer of Bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cum-Spl. Judge, NDPS Act, Gaya in connection with Imamganj P.S. Case No. 141 of 2023.
