2. The present application has been filed renewing prayer for anticipatory bail on account of the liberty granted to the petitioner to file a fresh petition vide order dated 11.07.2025 passed in Cr. Misc. No.86564 of 2024.
3. The petitioner apprehends his arrest in a case registered for the offences punishable under Section 406, 420, 467, 468, 471/34 of the Indian Penal Code.
4. The allegation in the first information report is that the accused persons including the present petitioner cheated an amount of Rs.8,75,000/- (Rupees Eight Lakh Seventy Five
Patna High Court CR. MISC. No.67864 of 2025(2) dt.26-09-2025 2/3 Thousand only) from the informant on the pretext of registering a land.

It is submitted by learned counsel for the petitioner that the first information report itself would disclose that the name of the petitioner has been included in the first part with regard to registry of land, but with regard to allegations of taking away of laptop etc. of the informant and also of executing the agreement were specific on co-accused persons, namely, Ranjeet Rajak and Vikash Kumar. The allegation against the petitioner is that he too had endorsed their signature. It has further been submitted that the dispute between the parties is with regard to differences over an agreement of sale with respect to an immovable property and further, allegation with regard to misappropriation of money is a result of a business transaction between the parties.
It has further also been submitted that there is unexplained delay of 21 days in lodging the first information report and the petitioner has no criminal antecedent and two co-accused persons, namely, Ranjeet Rajak and Vikash Kumar have already been granted privilege of anticipatory bail by co-ordinate Bench of this Court vide order dated 20.12.2024 passed in Cr. Misc. No.83567 of 2024.
6. Learned APP for the State opposed the prayer for
Patna High Court CR. MISC. No.67864 of 2025(2) dt.26-09-2025 3/3 bail.

Taking into consideration the facts and circumstances of the case and considering the nature of allegations against the petitioner coupled with the fact that two main accused persons have already been granted anticipatory bail by a co-ordinate Bench of this Court, let the above named petitioner, who has no criminal antecedent, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Civil Lines P.S. Case No. 341 of 2024, subject to the condition as laid down under Section 438 (2) of the Cr.P.C/ Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023.
