The petitioner is apprehending arrest in a case registered for the offences punishable under sections 341,323,420,406,409 and 506 of the Indian Penal Code. The prosecution case is that the petitioner persuaded the informant to make deposits in a non-banking financial organization, as a result, the petitioner deposited Rs.100400/- but when the pass-book got up-dated it was found that only Rs.93,700/- was deposited, hence consequently the maturity amount has not been returned.

It is submitted by the learned counsel for the petitioner that the deposit was made between 30.3.2011 to

Patna High Court Cr.Misc. No.35965 of 2016 (3) dt.08-09-2016 2/2 31.1.2013 and the remaining balance amount has also been deposited by the petitioner. More over, the delayed FIR has been registered in the background of Title Suit No. 210 of 2016 pending between the parties. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, it is a case for consideration of the prayer for bail of the petitioner by the learned court below in case he surrenders within six weeks from today in connection with Bakhtiyarpur P.S. Case No. 234 of 2016 pending in the court of learned CJM, Saharsa.

This application is disposed of with the aforesaid observation/direction.
