JUSTICE SANJAY PRIYA ORAL ORDER 23-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Buxar (Town) P.S. Case No. 56 of 2013 instituted for the offence under sections 149, 323, 504, 307, 379 and 427 of the Indian Penal Code and Section 27 of the Arms Act.

It has been submitted that petitioner is neither named in the FIR nor any charge-sheet has been submitted against him. The name of this petitioner has come during trial. The petitioner has been made accused during trial under section 319 Cr.P.C.

During investigation, charge-sheet has been submitted against co-accused Manish Kumar and trial has proceeded against him vide Sessions Trial No. 107/15, arising out of Buxar (Town) P.S.Case No. 56 of 2013.

Patna High Court Cr.Misc. No.12962 of 2017 (2) dt.23-03-2017 2/2 Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner named above, within six weeks from today, in connection with Sessions Trial No. 107 of 2015, arising out of Buxar (Town) P.S. Case No. 56 of 2013, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge,VIth, Buxar, subject to the conditions as laid down under Section 438(2) Cr.P.C.
