JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-05-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

Both the applications are related to Bagaha (Patkhauli) P.S. Case No. 62/2017, registered under Sections 420, 468, 471, 120-B/34 of the Indian Penal Code. Terefore, both bail

applications are being heard together and are being disposed of by common order.

The accusation is that Raj Kumar Pal joined as Data Entry Operator in the office of the Superintendent of Police, Bagaha on the basis of appointment letter no. 01/Asth.(Misc.)- 02/2016, 10351/Na.Vi.A.Vi, Patna, dated 14.12.2016 and also asked about the place of payment of salary. Thereafter, appointment letter of the petitioner Raj Kumar Pal was sent to Beltron Office, Patna for verification through e-mail then Sri Vijay Kumar, officer of Beltron Office, Patna informed that the appointment letter is fake. On query, Raj Kumar Pal informed that the appointment letter was handed over to him by Harikesh Das @ Harilesh Das.

Learned counsel for the petitioners submits that both the petitioners have no criminal antecedent and they are in custody since 04.02.2017 and charge-sheet has already been submitted against the petitioners.

Having regard to the facts and the circumstances of the case, the petitioners Harikesh Das @ Harilesh Das and Raj Kumar Pal, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the

learned Additional Chief Judicial Magistrate, Bagaha, West Champaran in connection with Bagaha (Patkhauli) P.S. Case No. 62/2017, Out of two sureties, one surety must be the close relative of the petitioners.
