JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 452, 376, 511 of the Indian Penal Code.

The accusation against the petitioner is that he made abortive bid to commit rape on the informant, who filed a complaint petition which was converted into police case. Submission on behalf of the petitioner is that petitioner happens to be an activist of Right to Information Act and had filed petition against the headmaster of Primary School, Keshanpur Tole Dayalpur which caused annoyance to aforesaid headmaster who managed the informant, who happens to be a lady

Patna High Court Cr.Misc. No.37359 of 2016 (2) dt.08-09-2016 2/2 of questionable character, and got instituted this false case against the petitioner.

In support of the aforesaid contention, learned counsel for the petitioner drew my attention towards the annexures attached with this petition.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in connection with Kurhani P.S. Case No. 77 of 2016.
