Having regard to the nature of allegation and the finding of the Doctor on the person of the deceased, this Court keeping in view that the petitioner is the husband and is facing allegation for the offences punishable under Section-304(B)/34 of the Indian Penal Code and the fact that such death of his wife has taken place within seven years of the marriage, will not be at least entitled for privilege of anticipatory bail.
That being so, the prayer for anticipatory bail of the petitioner is hereby rejected.
Nothing said in this order however will come in the way of the petitioner in surrendering before the Court below and making prayer for regular bail.
