The petitioner is apprehending his arrest in connection with Sabaur PS Case no.28/19 registered for offences punishable under Sections 406, 420, 323, 504, 506, 379 and 34 of the Indian Penal Code.

As per FIR, the petitioner happens to be LIC agent and the informant has given amount of Rs.3,10,000/- in installment on the plea that he will deposit the same against the policy but he has not deposited the same.

Submission of the learned counsel for the petitioner is that the money has been taken for depositing in the nonbanking but the bank has closed and he has also filed a complaint case against the bank also.

Ont he other hand the learned counsel for the informant

Patna High Court CR. MISC. No.57905 of 2019(4) dt.06-11-2019 2/2 has submitted that the non banking company was closed in the year, 2015 but in spite of that the petitioner has taken amount for depositing the same but not returning the amount now. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail.

With the aforesaid direction, this application is dismissed.
