====================================================== CORAM: HONOURABLE MR. JUSTICE V.N. SINHA ORAL ORDER 12-10-2015 Heard learned counsel for the petitioner and the State. Petitioner is apprehending his arrest in connection with a case registered for the offence under Sections 302/120B of the Indian Penal Code and Section 27 of the Arms Act. He is named in the First information Report as suspect in the murder case of Ramji Prasad Sah whose brother Sanjay Kumar Gupta is also a suspect in the case and the other brother is informant. Present petitioner is tenant of Sanjay Kumar Gupta and he has been named along with Sanjay Kumar Gupta in the present case as informant wants to get his shop vacated.

Sanjay Kumar Gupta having been admitted to the privilege of bail in the event of arrest, petitioner being tenant and only suspect in the case, is also directed to surrender in the court

Patna High Court Cr.Misc. No.40450 of 2015 (2) dt.12-10-2015 2/2 of Chief Judicial Magistrate, Ara in connection with Town P.S. Case No. 164 of 2015 within four weeks from the date of receipt/ production of a copy of this order and thereafter similar treatment be allowed to him, which has been allowed to Sanjay Kumar Gupta under order dated 22.07.2015 passed in Cr. Misc. No. 27374 of 2015.
