The petitioner apprehends his arrest in connection with Hajipur Sadar P.S. Case No.1051 of 2021 registered under Sections 307 of the Indian Penal Code and other allied sections of the I.P.C.
Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner has falsely been implicated in this case only to save himself from Hajipur Sadar P.S. Case No.1050 of 2021. The petitioner has got no criminal antecedent.
Learned A.P.P. for the State vehemently opposed the prayer for bail of the petitioner stating that there is specific
Patna High Court CR. MISC. No.61195 of 2022(2) dt.11-04-2023 2/2 allegation against the petitioner of assaulting the informant with sickle causing head injury to which the injury report also corroborates. Therefore, the petitioner does not deserve anticipatory bail.
Having considered the above facts and circumstances of the case as well as the nature of allegation made against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for bail is rejected. (Arvind Srivastava, J) Harish/- U T
