JUSTICE ARUN KUMAR ORAL ORDER 20-07-2018 Heard learned Counsel for the petitioner and the learned Counsel for the State as also the learned Counsel appearing for Union of India.

Petitioner, already in custody since 30.1.2018, seeks bail in Katihar Nagar (Sahayak) PS Case No. 73 of 2018, registered under Sections 8, 20(b)(ii)(C ), 25 and 29 of the NDPS Act. The allegation in brief is that from a truck coming from Tripura 644 Kilograms of Ganja was being smuggled in the driver's cabin was recovered and it is alleged that one Bolero vehicle was escorting the truck and the petitioner was also found in the Bolero vehicle.

Learned Counsel for the petitioner submits that there is no evidence to suggest that the petitioner was connected with the smuggling of ganja being carried away by the truck moreover from the bolero vehicle nothing was recovered except Rs. 100/- from the pocket of the petitioner and he has no criminal antecedent. Having considered the said facts and circumstances, the petitioner Arun Kumar @ Doctor is directed to be released on bail on

Patna High Court Cr.Misc. No.28848 of 2018 (6) dt.20-07-2018 furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge, Katihar in connection with Katihar Nagar (Sahayak) PS Case No. 73 of 2018.
