ANJANA MISHRA ORAL ORDER 16-09-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is in custody since 25.07.2019 in connection with Case No. C2/463/2019 registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the recovery of 36 litres of Nepali Sofi wine has been made from the motorcycle and not from the conscious possession of the petitioner.

In view of the aforementioned facts and circumstances, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand)

Patna High Court CR. MISC. No.57857 of 2019(2) dt.16-09-2019 2/2 with two sureties of the like amount each to the satisfaction of learned ADJ II cum Special Judge, Excise Act, Sitamarhi, in connection with Case No. C2/463/2019.
