Petitioner apprehends his arrest in connection with Chainpur P.S. Case No. 248 of 2011 registered for the offence punishable under Sections 304B/34 of the Indian Penal Code. Allegedly, the petitioner being the husband of the informant's daughter with aid and assistance of other co-accused killed her due to non-fulfillment of demand of dowry. Submission is that in this case after completing investigation final form was submitted as the case was not found true but differing with the final form cognizance has been taken against the petitioner only, resulting the petitioner is apprehending his arrest or detention.
Patna High Court Cr.Misc. No.29960 of 2014 (2) dt.16-01-2015 Learned APP fairly submits that in this case final form has been submitted vide annexure-2.
Considering the fact that against the petitioner final form has been submitted, and as such, the petitioner above named, in case of his surrender or arrest within two months from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri A. K. Singh, J. M. Ist Class, Kaimur at Bhabua in connection with Chainpur P.S. Case No. 248 of 2011, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Jitendra Mohan Sharma, J) avin/- U T
