In this application for anticipatory bail the petitioners apprehend their arrest in a case punishable for the offence under sections 341, 323, 324 and 307/34 of the I.P.C. and section 27 of the Arms Act.

Allegedly the petitioners being armed with Khanti and Lathi assaulted the informant when he was going on motorcycle resulting he fell down and again he was assaulted causing injury on his hand and leg and other co-accused were instigating to kill him but the informant succeeded in fleeing away and then firing was made which missed the target.

Submission is of false implication and that vide

Patna High Court Cr.Misc. No.30467 of 2014 (2) dt.21-01-2015 2/2 Annexure-2 simple injury has been found on the person of the informant and due to irrigate the field there was some altercation and the informant lodged this case with making allegation after thought.

The learned A.P.P. after going through Annexure-2 which is injury report fairly submits that simple injury has been found.

In the facts and circumstances as stated above, the petitioners in case of their arrest or surrender within two months from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of S.D.J.M. Daudnagar, District- Aurangabad in Uphara P.S. Case No. 65 of 2013, subject to the conditions as laid down in section 438 (2) Cr.P.C.
