Petitioner is apprehending his arrest in connection with a case registered for the offence under Section 302 and other allied Sections of the Penal Code, Section 27 of the Arms Act. He is named in the First Information Report as Accused No. 2, there are other five accused besides others. It is submitted that another First Information Report for the same occurrence was also registered by one Suman Kumar Singh bearing Amarpur P.S. Case No. 216/15 dated 11.07.2015, if both the First Information Reports are read together, it will appear that allegation set out against the

Patna High Court Cr.Misc. No.40390 of 2015 (2) dt.09-10-2015 petitioner is not wholly true.

Aforesaid submission of learned counsel for the petitioner can be better appreciated if the petitioner will surrender in the court below (Chief Judicial Magistrate, Banka) within four weeks from the date of receipt/production of a copy of this order in the court below and apply for regular bail in connection with Amarpur P.S. Case No. 215 of 2015, which should be considered in accordance with law in the light of the submissions noted above.
