JUSTICE SANJAY PRIYA ORAL ORDER 29-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Kotwali (Adampur) P. S. Case no. 479 of 2016 instituted for the offence under Sections 409 and 420 of the Indian Penal Code. There is allegation that petitioner did not submit the educational and other documents with regard to the appointment of Panchayat Teacher when demand was made in terms of the order passed in C.W.J.C. no. 15459 of 2014.
Submission on behalf of the petitioner is that he was not posted at alleged Panchayat on the alleged period of appointment. It is further submitted that other co-accused has already been granted anticipatory bail vide Cr. Misc. no. 7916 of
Patna High Court Cr.Misc. No.14547 of 2017 (2) dt.29-03-2017 2/2 2017.
Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Kotwali(Adampur) P.S. case no. 479 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhagalpur, subject to the conditions as laid down under Section 438(2) Cr. P.C.
