The petitioner seeks bail in Maner P.S. Case No. 590 of 2016, registered for the offences punishable under Section 30(A) of the Bihar Excise and Prohibition Act, 2016. The police intercepted a vehicle and arrested the petitioner Chottu Singh @ Sushil Kumar Singh @ Sushil Kumar @ Bablu Kumar. From the vehicle 230 bottles of Royal Stag and Denis Special Whisky each containing 750 ml. was recovered. Learned counsel for the petitioner submits that the petitioner has no manner of concern with the seized articles. The whisky was recovered from the hotel but the petitioner has falsely been implicated in the case. The owner of the line hotel managed to flee away.

Considering the facts that about 172 liters of Indian

Patna High Court Cr.Misc. No.14114 of 2017 (2) dt.18-04-2017 2/2 made foreign liquor was recovered from the vehicle of the petitioner and for that the petitioner is in jail since 01.01.2017 and the petitioner has already remained in jail for more than 31⁄2 months, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Danapur, Patna in Maner P.S. Case No. 590 of 2016.
