JUSTICE SUDHIR SINGH ORAL ORDER 19-10-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under sections 363, 366A, 372/34 of the Indian Penal Code.

Allegation against the petitioner is of kidnapping the daughter of the informant.

It has been submitted on behalf of the petitioner that he is in custody since 14.5.2016. Charge sheet has been submitted against the petitioner. The petitioner has no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioner. It has also been submitted that the victim girl has been recovered. Her statement under section 164 Cr.P.C. has been recorded. There is no allegation of inducement or any sexual or physical abuse against the petitioner.

On behalf of the State, it is submitted that the petitioner is

Patna High Court Cr.Misc. No.34858 of 2016 (3) dt.19-10-2016 not named in the First Information Report.

Considering the aforesaid facts and circumstances, let the abovenamed petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Pupari at Sitamarhi in Sursand P.S.Case No. 251/2015.
