Petitioner is languishing in custody for the offences punishable under Sections 414, 506 and 427/34 of the Indian Penal Code and Sections 25(1-B)a, 26/35 of the Arms Act. A country made loaded pistol was allegedly recovered from the possession of this petitioner. Petitioner is in custody since 23.10.2016.
Considering the nature of allegation, let petitioner, above named, be enlarged on bail, after completing nine months in custody, on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Dalsingsarai,
Patna High Court Cr.Misc. No.12818 of 2017 (3) dt.28-03-2017 Samastipur/Successor Court, in connection with Ujiyarpur P.S. Case No.170 of 2016, subject to the condition that both the bailors shall be local resident within the territorial jurisdiction of the court below having immovable property and subject to the further condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
