2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 341 , 323 , 448 , 354, 379, 307, 506 and 34 of the Indian Penal Code and section 27 of the Arms Act.
3. Allegation against the petitioner is that he along with other co-accused persons brutally assaulted the informant. It is further alleged that this petitioner made firing with desi pistol and threatened to kill the informant.
4. It is submitted that though petitioner is alleged to made firing but no one sustained first arm injury . Specific accusation is against other co-accused person so far as this petitioner is concerned there is general and omnibus allegation
Patna High Court CR. MISC. No.64259 of 2023(2) dt.16-10-2023 2/2 against him. Petitioner claims clean antecedent.
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Fast Court, Gaya in connection with Bodh Gaya P.S. case No. 269 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
